Privacy Policy
Last updated: September 28, 2026
Important: This Privacy Policy is a business draft written to support WAKAPAY’s operations and compliance posture. Have counsel review it for Cameroon, UAE, GDPR/UK GDPR, and other markets you serve before treating it as final.
1. Who we are
This Privacy Policy explains how WAKAPAY (“WAKAPAY”, “we”, “us”) collects, uses, shares, and protects personal data when you use our websites, dashboards, APIs, and checkout experiences (the “Service”).
Controller contact: info@wakapay.cash — Douala, Cameroon. Merchant app: account.wakapay.cash.
2. Scope and roles
When you create a seller account, we generally act as an independent controller of account and billing data. When you use WAKAPAY to accept payments, we may process buyer and transaction data to operate checkout and fraud controls. Depending on the flow and jurisdiction, we or a payment provider may act as controller or processor — we will clarify in contracts or provider terms where required.
On-chain crypto activity is public by design. Wallet addresses and transaction hashes you use may be visible on public blockchains outside our control.
3. Data we collect
- Account data: name, email, password or auth tokens, business details, phone, country, and profile settings.
- KYC/compliance data: identity documents, proof of address, beneficial ownership, and similar information when we or our providers request it.
- Payment configuration: connected wallet addresses, preferred assets/networks, fiat payout or provider settings, invoice and product metadata.
- Transaction data: amounts, currencies/assets, status, timestamps, invoice IDs, webhook delivery logs, and limited buyer identifiers you or providers supply (e.g. email for receipts).
- Usage and device data: IP address, browser/device type, pages viewed, referrers, cookies or similar technologies, and diagnostic logs.
- Communications: support messages, email/WhatsApp inquiries, and survey responses.
We do not ask for your crypto private keys or seed phrases. Never share them with anyone claiming to represent WAKAPAY.
4. How we use data
We use personal data to:
- Provide, operate, secure, and improve the Service;
- Create invoices, track payment status, and send webhooks;
- Bill fees, prevent fraud, and enforce our Terms;
- Meet KYC/AML, sanctions, tax, and other legal obligations;
- Communicate about the Service, security, and product updates;
- Analyze aggregated or de-identified usage to understand product performance;
- Protect our rights, users, and the public against abuse or harm.
Where required, we rely on one or more of: contract performance, legitimate interests (security, product improvement, fee collection), legal obligation, and consent (where we ask for it, e.g. certain cookies or marketing).
5. Sharing and disclosures
We may share data with:
- Infrastructure, analytics, email, and support vendors under contracts that limit use to providing services to us;
- Fiat payment providers, banking partners, and on-chain monitoring tools as needed to process or verify payments;
- Professional advisors (legal, accounting) under confidentiality;
- Authorities, courts, or regulators when we believe disclosure is required or appropriate to comply with law, legal process, or to protect rights, safety, and security;
- A buyer or counterpart only as needed to complete a transaction you initiate (e.g. merchant name on checkout);
- Successors in a merger, acquisition, financing, or sale of assets, subject to this Policy’s spirit.
We do not sell personal data for money. We may use limited advertising or analytics technologies that some laws treat as “sharing” — manage preferences where we provide controls.
6. International transfers
We operate from Cameroon and may use vendors in other countries (including the UAE, EU/EEA, US, or elsewhere). Where required, we use appropriate safeguards for cross-border transfers. Public blockchain data may be replicated globally by nature of the network.
7. Retention
We retain data as long as needed for the purposes above, including account life plus periods required for disputes, audits, fee collection, fraud prevention, and legal retention (often several years for financial/compliance records). We may retain aggregated or de-identified data longer.
8. Security
We implement technical and organizational measures designed to protect personal data. No method of transmission or storage is 100% secure. You are responsible for safeguarding account credentials and wallet keys.
9. Your choices and rights
Depending on your location, you may have rights to access, correct, delete, restrict, or port personal data, object to certain processing, or withdraw consent. Contact info@wakapay.cash. We may verify your identity and refuse requests that are unlawful, excessive, or would impair our rights, security, or others’ privacy.
Marketing emails (if any) include unsubscribe options. Essential service messages are not marketing.
10. Children
The Service is not directed to children under 18 (or the age of majority where higher). We do not knowingly collect personal data from children. If you believe we have, contact us to delete it.
11. Cookies and similar technologies
We use cookies and similar technologies for authentication, security, preferences, and analytics. You can control cookies through browser settings; disabling some may break the Service.
12. Changes
We may update this Policy by posting a new version with an updated date. Material changes may be communicated by email or in-product notice where appropriate. Continued use after the effective date means you acknowledge the updated Policy.
